Agreement to These Terms

These Terms of Use (“Terms”) constitute a legally binding agreement between you (“User” or “you”) and Vanphil Silver Services Inc, doing business as Silver Caregivers, Inc. (“Silver Caregivers,” “we,” “us,” or “our”), a Florida corporation licensed by the Agency for Health Care Administration (AHCA License #299996278) to provide non-medical in-home care services in Broward County, Florida.

By accessing or using our website at silvercaregivers.org (the “Site”), you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must discontinue use of this Site immediately.

We reserve the right to modify these Terms at any time. Changes take effect when posted to this page. The “Effective Date” at the top of this document will be updated when material changes are made. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

About Silver Caregivers Inc

Silver Caregivers, Inc. is a licensed non-medical home care agency serving seniors and adults with disabilities throughout Broward County, Florida. Our services include companionship, personal care support, assistance with activities of daily living, respite care, and in-home assistance for clients aging in place or returning home after hospitalization.

We are not a medical provider, hospital, physician practice, or licensed healthcare facility. Nothing on this Site constitutes medical advice, diagnosis, treatment, or a patient-provider relationship. See Section 4 for our full Medical Disclaimer.

Eligibility and User Responsibilities

1. Age Requirement

   You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use this Site. By using this Site, you represent and warrant that you meet this requirement. We do not knowingly permit persons under the age of 18 to use this Site. If you are a parent or guardian and believe a minor has accessed this Site, please contact us at info@silvercaregivers.org

2. Acceptable Use

   You agree to use this Site only for lawful purposes and in a manner that does not infringe the rights of others. You agree not to:

   • Use the Site to transmit any unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable content
   • Attempt to gain unauthorized access to any portion of the Site, our servers, or any systems connected to the Site

Silver Caregivers, Inc. provides non-medical in-home care services only. Our caregivers are not licensed medical professionals and do not provide clinical, therapeutic, or medical services. Any health-related information on this Site is general in nature and does not create a provider-patient relationship between you and Silver Caregivers, Inc.

Links to third-party health resources, organizations, or websites are provided for informational convenience only and do not constitute an endorsement of the accuracy, reliability, or completeness of that information. You should independently verify any health information before acting on it.

• Loss of data or information
• Business interruption
• Personal injury arising from use of this Site (as distinct from our in-home care services)
• Any errors or omissions in content
• Unauthorized access to or alteration of your data

This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if Silver Caregivers, Inc. has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you in full.

Our total liability to you for any claim arising from your use of this Site shall not exceed one hundred dollars ($100.00). This limitation does not apply to our direct in-home care services, which are governed by separate service agreements.

Indemnification

You agree to indemnify, defend, and hold harmless Silver Caregivers, Inc. and its officers, directors, employees, agents, and representatives from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of or access to this Site; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your infringement of any third-party right, including intellectual property rights.

Governing Law and Dispute Resolution

These Terms and any disputes arising out of or related to them or your use of this Site are governed by the laws of the State of Florida, without regard to its conflict of law principles. You agree that any legal action or proceeding arising from these Terms or your use of this Site shall be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to personal jurisdiction in those courts.

Before initiating any legal proceeding, you agree to first contact us in writing at info@silvercaregivers.org and provide us a reasonable opportunity of no less than 30 days to address your concern. This requirement does not apply to claims for emergency injunctive relief.

General Provisions

1. Severability

   If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible. The remaining provisions will continue in full force and effect.

2. No Waiver

   Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Silver Caregivers, Inc. to be effective.

3. Entire Agreement

   These Terms, together with our Privacy Policy, constitute the entire agreement between you and Silver Caregivers, Inc. regarding your use of this Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties related to the same subject matter.

4. Assignment

   You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
